Overview

Welcome to nutfreed! The terms "we", "us" and "our" refer to nutfreed, the trading name of NUTFREED LTD (company number 17053043), a company registered in England and Wales. nutfreed operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). nutfreed is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced in them (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services. This includes our informational content, our Nut Allergy Radar, our Translation Cards, and our marketplace of nut-free products from independent vendors - see our nutfreed Policy page for more detail on how these different parts of nutfreed work.

Please read these Terms of Service carefully, as they include important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service, our Privacy Policy, and our nutfreed Policy. If you do not agree to these, you should not use or access our Services.

Section 1 - Access and Account

By agreeing to these Terms of Service, you represent that you are at least 18 years old, or the age of majority in your country of residence if that's different, and that you have given us your consent to allow any of your minor dependants to use the Services on devices you own or manage.

To use the Services - including browsing our online store or purchasing any products or services we offer - you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current and complete, and that you have all rights necessary to provide it.

You are solely responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, assign, or license your account to any other person.

Section 2 - Our Products

We make every effort to provide an accurate representation of our products and services, and of the vendor products listed on our marketplace. However, product appearance may differ from how it appears on your screen due to your device and its settings, and translated content is provided as a communication aid rather than a certified professional translation - see our nutfreed Policy page for the specific disclaimer that applies to our Translation Cards.

Descriptions of products are subject to change at any time without notice at our discretion. We reserve the right to discontinue any product at any time and may limit the quantities we offer to any person, region, or jurisdiction.

Section 3 - Orders

When you place an order for one of our own products (currently, our Translation Cards), you are making an offer to purchase, and nutfreed reserves the right to accept or decline your order for any reason at its discretion. We must receive and process your payment before your order is accepted.

Where you purchase a product from a vendor through the nutfreed Marketplace, your order and contract of sale is with that vendor, not with nutfreed - nutfreed operates the platform that connects you, but is not the seller of the product. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale.

Section 4 - Prices and Billing

Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed, as set out in your order confirmation email. Unless expressly stated, posted prices do not include taxes, shipping, handling, customs, or import charges.

We may offer promotions from time to time that are governed by their own separate terms; if there's a conflict between promotion terms and these Terms, the promotion terms govern.

You agree to provide current, complete and accurate payment and account information, and to keep it up to date. You represent and warrant that any payment information you provide is true and complete, that you're authorised to use the payment method provided, and that you will pay all charges incurred at the posted prices, including any applicable shipping, handling, and taxes.

Section 5 - Delivery of Digital Products and Marketplace Orders

Our own products, currently our Translation Cards, are digital products delivered electronically - there is no physical shipping involved, and delivery is generally immediate on completion of your order.

Products purchased from a vendor through the nutfreed Marketplace are shipped directly by that vendor, in accordance with that vendor's own shipping and delivery arrangements. We are not liable for delivery delays, loss, or damage relating to products shipped by a vendor. See our nutfreed Policy page for more on the marketplace and your relationship with vendors.

Section 6 - Intellectual Property

Our Services - including all trademarks, brand assets, text, displays, images, graphics, translation card content, product reviews, video, and audio, and their design, selection, and arrangement - are owned by nutfreed, its affiliates, or licensors, and are protected by UK and international copyright, trademark, and other intellectual property laws.

These Terms permit you to use the Services, including any Translation Card you purchase, for your own personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, resell, or otherwise share any material from the Services - including the content of a Translation Card - without our prior written consent. Nothing in these Terms grants you any licence or other rights under any patent, trademark, copyright, or other intellectual property of nutfreed, Shopify, or any third party, except as expressly stated. All rights not expressly granted are reserved by nutfreed.

nutfreed's names, logos, product and service names, designs, and slogans are trademarks of nutfreed or its affiliates or licensors, and must not be used without our prior written permission. Shopify's name, logo, and related marks are trademarks of Shopify. All other names, logos, and marks on the Services belong to their respective owners.

Section 7 - Optional Tools

You may be given access to tools offered by third parties as part of the Services, which we neither monitor nor control. We provide access to such tools "as is" and "as available", without any warranties or endorsement, and we have no liability arising from your use of them. Any use of optional third-party tools is at your own risk, and you should review the relevant third party's own terms before using them.

We may, in future, offer new features through the Services. These will also be deemed part of the Services and subject to these Terms.

Section 8 - Third-Party Links

The Services may contain links to websites operated by third parties, including vendor websites and embedded third-party functionality. We do not examine or evaluate the content of any third-party materials or sites you choose to access, and if you leave the Services to access them, you do so at your own risk.

We are not liable for any harm relating to your access of third-party websites, or your purchase or use of any products, services, or content on them. Please review the third party's own policies before engaging in any transaction with them. Complaints regarding third-party products or services should be directed to that third party in the first instance - see our nutfreed Policy page for how this applies to marketplace vendors specifically.

Section 9 - Relationship With Shopify

nutfreed is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make through our Services are made directly with nutfreed (or, for marketplace products, with the relevant vendor). By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and nutfreed (or a vendor), including any injury, damage, or loss resulting from a purchased product or service. You release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions made through the Services.

Section 10 - Privacy Policy

All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these privacy policies.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit may be transmitted to and shared with Shopify, as well as third parties (including marketplace vendors, where relevant to fulfilling your order) that may be located in other countries. Section 11 - Feedback

If you submit any ideas, suggestions, feedback, reviews, or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish, and display that Feedback for any purpose, including commercial use - for example, operating, improving, and promoting the Services.

You represent and warrant that you own or have the necessary rights to any Feedback you submit, and that it will comply with these Terms. We're under no obligation to keep your Feedback confidential, compensate you for it, or respond to it, and we may (but have no obligation to) monitor, edit, or remove Feedback we consider unlawful, offensive, or otherwise objectionable.

You agree that your Feedback will not infringe any third party's rights, contain anything unlawful, abusive, or defamatory, or contain any virus or malware. You may not use a false identity or otherwise mislead us or others as to the origin of your Feedback. You're solely responsible for your Feedback and its accuracy.

Section 12 - Errors, Inaccuracies and Omissions

Occasionally there may be typographical errors, inaccuracies, or omissions on the Services relating to product descriptions, pricing, promotions, or availability - including in vendor listings on our marketplace. We reserve the right to correct these, and to change, update, or cancel orders affected by inaccurate information, at any time without prior notice, including after an order has been submitted.

Section 13 - Prohibited Uses

You may access and use the Services for lawful purposes only. You may not use the Services: (a) for any unlawful or malicious purpose; (b) to violate any applicable law or regulation; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, or harm any other person; (e) to transmit false or misleading information; (f) to send or upload material that doesn't comply with these Terms; (g) to send spam or unsolicited promotional material; (h) to impersonate any other person or entity; or (i) to interfere with anyone else's use or enjoyment of the Services, or to expose nutfreed, Shopify, or other users to liability.

You also agree not to: upload viruses or malicious code; reproduce, extract, or resell any portion of the Services; collect or track other people's personal information; use scraping, bots, automated tools, or AI/agentic tools to access the Services other than as permitted under Section 14; or bypass or interfere with any security or access-control measures we use. We may suspend, disable, or terminate your account at any time, without notice, if we reasonably determine you've violated these Terms.

Section 14 - Agents

This section applies if you use, allow, or cause an "Agent" - any software that takes autonomous or semi-autonomous action on behalf of a person, without direct supervision - to access or interact with the Services.

No Agent may access the Services unless it identifies itself and operates strictly in accordance with the requirements below, and no Agent may access the Services if we've asked that Agent to stop. We may limit, including by technical measures, whether and how Agents access the Services.

Agents must: identify themselves as an Agent in all requests (via the user agent string, e.g. "Agent/[agent name]"); not conceal that they are an Agent, including by mimicking human behaviour or bypassing CAPTCHAs; respond truthfully to any question about whether they're a human or a computer; and not circumvent any measure intended to control Agent access to the Services.

Section 15 - Termination

We may terminate this agreement or your access to the Services, in whole or in part, at our discretion and without notice. You'll remain liable for all amounts due up to the date of termination.

Sections relating to Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, and Governing Law will continue to apply after termination, along with any other provision that by its nature should survive.

Section 16 - Disclaimer of Warranties

Information presented on or through the Services - including our informational content, Nut Allergy Radar, and any product listings - is made available for general information purposes. We don't warrant the accuracy, completeness, or usefulness of this information, and any reliance you place on it is at your own risk. See our nutfreed Policy page for the specific disclaimer that applies to allergy and safety-related content.

Except as expressly stated by nutfreed or required by law, the Services and all products offered through them are provided "as is" and "as available", without warranties or conditions of any kind, whether express or implied, including implied warranties of satisfactory quality, fitness for a particular purpose, and non-infringement. We don't guarantee that your use of the Services will be uninterrupted, timely, secure, or error-free.

Nothing in this section affects your statutory rights as a consumer - for example, your rights under the Consumer Rights Act 2015 in relation to goods, digital content, or services not being of satisfactory quality, fit for purpose, or as described, where those rights can't lawfully be excluded.

Section 17 - Limitation of Liability

To the fullest extent permitted by law, nutfreed, our partners, directors, officers, employees, affiliates, agents, contractors, service providers, or licensors (or those of Shopify and its affiliates) will not be liable for any indirect, incidental, special, or consequential damages - including lost profits, lost revenue, or loss of data - arising from your use of the Services or any product procured through them, whether based in contract, tort (including negligence), or otherwise, even if advised of the possibility of such damages.

This limitation does not apply to, and nothing in these Terms excludes or limits: our liability for death or personal injury caused by our negligence; our liability for fraud or fraudulent misrepresentation; or any other liability that cannot be excluded or limited under applicable law, including your statutory rights as a consumer.

Section 18 - Indemnification

You agree to indemnify and hold harmless nutfreed, Shopify, and our respective affiliates, officers, directors, employees, agents, and service providers from any losses, damages, liabilities, or claims (including reasonable legal fees) arising from: your breach of these Terms; your violation of any law or a third party's rights; or your access to and use of the Services.

We'll notify you of any indemnifiable claim. We may control the defence and settlement of such a claim at your expense, but won't settle any claim requiring a non-monetary obligation from you without your consent, which won't be unreasonably withheld. You'll cooperate with the defence of any indemnified claim.

Section 19 - Severability

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the unenforceable part will be severed - this won't affect the validity of the remaining provisions.

Section 20 - Waiver; Entire Agreement

Our failure to exercise or enforce any right under these Terms doesn't waive that right. These Terms, together with any policies we post (including our nutfreed Policy and Privacy Policy), constitute the entire agreement between you and us regarding your use of the Services, superseding any prior agreements or communications. Any ambiguity in these Terms won't be construed against whichever party drafted them.

Section 21 - Assignment

You may not transfer or assign these Terms or your rights or obligations under them without our prior written consent; any attempt to do so is void. We may transfer or assign these Terms and our rights and obligations without notice to you.

Section 22 - Governing Law

These Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes), are governed by and construed in accordance with the laws of England and Wales. You and nutfreed agree to submit to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom or in the European Union, this clause does not deprive you of any protection you're entitled to under the mandatory consumer protection laws of the country in which you live, and you may be entitled to bring proceedings in the courts of that country.

Section 23 - Headings

Headings used in these Terms are included for convenience only and don't limit or affect their meaning.

Section 24 - Changes to These Terms

We reserve the right to update, change, or replace any part of these Terms at any time by posting updates to our website. It's your responsibility to check this page periodically. We'll notify you of any material changes in accordance with applicable law. Your continued use of the Services after changes are posted constitutes acceptance of those changes.
